User Registration Agreement

【Special Reminder】Please carefully read the acbuy user registration agreement to ensure that you understand the rules for us to process your personal information. If you do not agree to any terms of this agreement, you can immediately stop visiting and using acbuy. acbuy may update this acbuy user registration agreement from time to time. The updated terms and conditions of this agreement will replace the original terms and conditions once they are released. Users can view the updated terms and conditions on the acbuy platform. After the terms of this agreement are modified, if you do not accept the modified terms, please immediately stop using the services provided by acbuy. The continued use of services by users will be deemed as acceptance of the modified agreement.

【Special Reminder】The acbuy user registration agreement consists of the acbuy service agreement, acbuy service terms and acbuy user privacy policy. After you complete the entire registration process and agree to this agreement, it means that you have fully read, understood and accepted all the terms of this agreement. If there is any dispute between you and acbuy due to the acbuy platform service, such disputes shall be resolved in accordance with the acbuy service agreement.

If you do not agree to this agreement or any of its terms, you should immediately stop the registration process.

Service Agreement

I. User’s confirmation and acceptance

The ownership and operation rights of the electronic services under this agreement (referring to the services provided by www.acbuy.com and its mobile software and applications) belong to acbuy. After you agree to all the registration terms and complete the entire registration process, you can become an official user of acbuy. When you click “Agree to this agreement”, it is deemed that you confirm that you have the ability to enjoy the services provided by acbuy, including but not limited to purchasing agency services, and independently bear the legal responsibilities arising therefrom. Unless otherwise agreed by you and acbuy, this agreement is binding on you and acbuy and is permanently effective.

II. Services provided by acbuy for enterprises

1. Package forwarding and purchasing agency service policies

(1) acbuy product search and display service

In order to facilitate your communication with sellers on platforms such as Taobao and 1688 to purchase goods, acbuy will display the sales and shopping links of sellers on platforms such as Taobao and 1688 so that you can directly complete the search for goods through the links and go to the corresponding product detail page or website to further understand product information or communicate with sellers. acbuy does not have an actual sales function and is not an actual sales entity or sales platform. acbuy does not have the function of actually selling goods and is not an actual sales entity or sales platform.

(2) Purchasing agency and package forwarding service

Purchasing agency service: All purchasing agency services under this agreement are independently provided to you by a third-party purchaser. Currently, the third-party purchaser is providing you with free services. However, you need to pay in advance for the goods you need for purchasing agency.

However, if you entrust a purchasing agent to provide you with a purchasing agency service for a third-party merchant, you need to pay acbuy for the cost of the goods required for purchasing agency. Specifically, it is the purchase price and logistics price of the goods you choose for purchasing agency (considering exchange rate fluctuations and settlement time, there may be slight differences in actual calculation).

You agree that acbuy can directly add the necessary service fee when you confirm the payment for purchasing agency goods. Failure to pay the platform service fee at the same time will result in the inability to generate and verify your purchasing agency order.

Package forwarding: If the goods in your purchasing agency order involve cross-border transportation, acbuy will recommend a third-party logistics provider for you. You are responsible for independently choosing a logistics provider who will serve you independently. You need to pay the freight to the logistics provider and the platform service fee to acbuy. The specific platform service fee is calculated at 8% of the freight (considering exchange rate fluctuations and settlement time, there may be slight differences in actual calculation).

You agree that acbuy can directly add the platform service fee when you confirm the payment of freight. Failure to pay the platform service fee at the same time will result in the inability to generate and verify your shipping label. acbuy is not responsible for any customs penalties, delivery delays, damages or losses that occur during the international package transportation. All risks need to be evaluated and borne by you.

If there is a problem with the package, you can authorize acbuy as a communication agent to negotiate claims with the third-party logistics provider. Disputes and controversies between users and third-party logistics providers have nothing to do with acbuy. All compensation-related matters are subject to the standards of the third-party logistics provider. acbuy is not responsible for these matters and does not bear joint liability.

(3) Product purchase and package forwarding disclaimer

In order for the goods you purchased to arrive smoothly, acbuy may properly handle the arrived goods. Some merchants on some purchasing platforms may engage in illegal business activities. acbuy cannot review the information of purchasing platforms/merchants/products and/or services one by one, nor can it review and verify the quality, safety, legality, authenticity and accuracy of the purchasing platforms/merchants/products and/or services involved in the transaction. Please purchase carefully.

(4) No-reason return and exchange rules within 5 days

You must understand that acbuy provides entrusted purchasing services and is not an online commodity seller. The “Interim Measures for No-reason Return of Online Shopping Goods within 7 Days” is not applicable. The products purchased by acbuy on your behalf can be returned and exchanged without reason within 5 days (depending on the specific situation). You must understand and confirm that such return and exchange services can only be enjoyed once for free within 30 days. Otherwise, subsequent returns and exchanges may incur certain fees, and some orders may not be returned and exchanged.

(5) Package forwarding agreement and inspection rules

You are responsible for understanding international prohibited items and relevant laws and regulations. acbuy can sign for and inspect your package according to the package forwarding and return receipt rules, receive packages that meet the requirements and carry out subsequent related operations.

(6) Domestic return and international return

Due to the particularity of international logistics, some packages may be marked as “failing domestic security inspection” at the customs of the sending country. In this regard, acbuy can arrange free re-delivery after your package is sent out. The package is returned. If your package has been sent overseas and is returned due to reasons such as failing international security inspection, no recipient, incorrect or incomplete address, or failed delivery, you need to bear the re-delivery cost.

The domestic return in this agreement only applies to mainland China.

(7) Delivery delay insurance and compensation

If the package exceeds the time of the insured delivery route announced by the platform since it is sent to the third-party carrier, it is deemed as a package delay. For compensation for delayed delivery, after the recipient applies for compensation, acbuy can negotiate with the relevant third-party logistics service provider. The compensation can be returned to the customer account of the international package, but on the premise that: due to the actions, decisions or orders of government and judicial organs such as customs, weather, traffic control, strikes, regulatory policy modifications, terrorist events, robberies, violent crimes such as looting, wars, and other force majeure factors, no compensation will be given.

(8) Package insurance and compensation

If your package is lost and you have purchased package insurance when submitting the order, the insurance company can provide corresponding compensation according to your insured value. You should understand that if the package contains international prohibited items or the package is lost due to certain factors (please refer to the insurance policy for details), you must bear full responsibility for the loss of the package.

(9) Receiving the package

Normal confirmation of receiving the package means the end of the entire transportation process. You should carefully check the outer packaging box when signing for it. If there are any relevant questions after signing for it, you can reply to the customer service staff immediately.

(10) After-sales service

It is recommended that you confirm receipt on the website after receiving the package. If necessary, you can apply for after-sales service within the validity period of after-sales service. Otherwise, after the expiration of this period, no after-sales service will be provided. The effective after-sales period is calculated based on the number of delivery days and the confirmation of receiving the product.

(11) Worry-free compensation policy

Before using the services under this agreement, you should understand the relevant rules of all businesses and services provided by acbuy, fully understand and confirm all your rights and obligations under this agreement.

(12) Disclaimer of compensation

(1) acbuy is committed to providing you with international online shopping services. In the following special circumstances, it is deemed that you agree and approve acbuy to carry out subsequent operations. If you have any questions, please contact the customer service staff for verification when submitting the order.

a) Sensitive goods:

In order for your package to be delivered smoothly, sensitive goods including essential oils, care solutions, lubricants, batteries, and glue may be taken out by acbuy.

b) Customs policies:

Counterfeit goods, goods containing a large amount of liquid or powder, or goods with batteries, food or medicine, etc., due to the influence of customs policies, may have certain delivery risks. acbuy is not responsible for customs clearance and related legal responsibilities due to the consequences arising from the above risks.

c) Unable to conduct professional inspections

acbuy may not be able to provide professional inspections (in terms of quality, authenticity, integrity, etc.) for some goods (such as electrical appliances, counterfeit goods, tickets, cards, models, etc.). In this regard, our inspectors may only check whether the appearance is intact and whether the accessories are complete. Whether it is complete, acbuy cannot open the product to check the quality. Therefore, acbuy does not make any guarantees or assume any responsibilities for the quality of our products.

d) Fragile goods

Since goods such as ceramics, glass and irregularly shaped goods (wiper blades, shock absorbers) may be worn or broken during multiple transports, acbuy recommends that you purchase carefully. acbuy can ensure that the goods are complete before shipment. However, if the goods are judged by the logistics service provider as fragile goods and are damaged during transportation, any losses and responsibilities arising therefrom shall be borne by you.

e) Customized goods

If you order customized goods, it is recommended that you directly negotiate with the merchant. You can purchase such goods according to your ideas and creativity. After successful negotiation, you should provide us with your contact information with the merchant. Since acbuy cannot provide professional inspections for this kind of goods, any losses and responsibilities arising therefrom shall be borne by you.

f) Deposit order

Due to the regulations of Taobao sellers, orders with deposits paid cannot be cancelled. The buyer needs to actively pay the balance according to the information released by the seller before the goods can be shipped. If the balance is not paid within the due time, the deposit will not be refunded.

g) Sellers with poor reputation

We recommend that you choose stores with a reputation of three stars or above and have paid the Taobao deposit to purchase goods. Stores with low reputation and no deposit paid may have disputes such as sellers not shipping, false shipping, after-sales service, and legal rights protection. The losses caused thereby need to be borne by you.

h) CD products and models

Since CD products and figure models have high collection value, and such products cannot be inspected by opening the plastic packaging bag, acbuy only checks whether the appearance is intact and will not check the internal situation. All risks and responsibilities arising therefrom shall be borne by you.

If your order has the risks specified in the preceding paragraph, it is deemed that you have read and accepted the above terms. Please read carefully. acbuy reserves the right of final interpretation.

(2) acbuy is not responsible for any loss, shortage, damage or delay of mails during delivery caused by non-acbuy reasons, specifically as follows:

a) The same situation occurs due to force majeure events (except for insured mails);

b) The mailed goods violate the restrictions and limitations and have been confiscated or otherwise disposed of by the competent authority in accordance with the regulations;

c) When the mail is delivered, the packaging is intact, without disassembly or weight loss, but the contents are short or damaged;

d) The receipt is signed by the recipient;

e) The mail is lost or delayed due to any reason of the user or the goods contained therein;

f) The user has not made inquiries or claims from the date of mail delivery until the expiration of the inquiry period;

g) International mails are detained, confiscated or destroyed by the competent authorities of the country of delivery or the transit country of the mail in accordance with their national laws;

h) Other reasons not attributable to acbuy.

(3) Prohibited items description

Prohibited items for mailing include:

a) Goods prohibited from circulation and delivery by national laws and regulations;

b) Explosive, flammable, corrosive, radioactive, toxic and dangerous goods;

c) Reactionary newspapers, books, windows or obscene items;

d) All kinds of currencies;

e) Items that may damage public health;

f) Perishable items;

g) Any live animals (except bees, silkworms and leeches whose packaging can ensure transportation safety and workers’ safety);

h) Such items are improperly packaged and may endanger personal safety or may contaminate or damage mails or other mail equipment;

i) All other items not suitable for mailing conditions.

(4) Postal practice prohibits delivery in the following circumstances:

a) According to its nature or packaging, it may or is suspected to harm postal service personnel or damage mails or postal equipment;

b) Items sealed with metal buttons with sharp edges that may interfere with mail handling equipment;

c) All kinds of firearms, ammunition, explosives, inflammable items, corrosive items, radioactive elements and containers, potent poisons, narcotic drugs, biochemical products, infectious items;

d) All kinds of publications, promotional materials and printed materials that endanger social security and stability or are obscene;

e) All kinds of items that may endanger public health;

f) Documents or goods prohibited from entering or circulating by the other party;

g) In addition to the above items, other items prohibited by the customs authorities.

h) Items prohibited from mailing as stipulated by Taiwan region’s mailing regulations.

(5) According to its nature or packaging, it may or is suspected to harm postal service personnel or damage mails or postal equipment;

a) Items sealed with metal buttons with sharp edges that may interfere with mail handling equipment;

b) Flammable, explosive or other dangerous items except brittle biological materials packaged and sent from one registered entity to another and permitted by the competent authority;

c) Live animals (except bees, silkworms, leeches or parasites) or insects used to eliminate pests sent from one registered entity to another;

d) Radioactive items;

e) Opium, morphine and other narcotic items except transportation documents, which have been issued by the competent authority or proved by the competent judicial authority or police authority for evidentiary purposes and have been insured or declared in value, or have been permitted by the competent authority, insured and used for medical or scientific research;

f) Obscene or indecent documents or items delivered by registered mail or package, except those proved for evidentiary purposes by the competent judicial authority or police authority;

g) Documents or items prohibited from entering by the competent authority of the country where the mail is delivered;

h) Documents or items prohibited from being sold or manufactured by the competent authority in Taiwan region, except those proved for evidentiary purposes by the competent judicial authority or police authority and delivered by registered mail or package;

i) Lottery tickets and their flyers, except those proved for evidentiary purposes by the competent judicial authority or police authority and delivered by registered mail or package;

j) Other prohibited items stipulated by laws and regulations.

Under no circumstances shall acbuy be liable for indirect losses or unrealized benefits.

2. 1688 purchasing agency service rules

The purchasing agency service under this agreement is provided by a third-party purchasing company to assist you in purchasing the goods you specify from 1688 sellers. acbuy does not guarantee the quality of 1688 products and does not provide accurate inventory services. It only provides limited sample services and limited after-sales services. Please choose goods carefully and bear the risks by yourself. If you need a guaranteed purchase, you can use acbuy’s expert purchasing service.

III. Explanation of international logistics restrictions

Goods purchased in China must comply with the laws and regulations of the People’s Republic of China (hereinafter referred to as the “People’s Republic of China”) and be allowed to be exported. You understand and acknowledge that due to the differences in customs policies of various countries, some countries or regions are more sensitive to special goods. The probability of such goods being confiscated by the local customs when entering the local customs is slightly higher. acbuy is not responsible for goods being confiscated, destroyed or detained by the local customs at the place of receipt due to the above reasons.

The inspection of packages by the customs is basically in the form of spot checks. If the customs thinks that your package is special (such as too large in size, too heavy in weight, or contains sensitive goods, etc.), the customs will actively contact the recipient to request an invoice or customs clearance document. Please ask the entrusted purchaser to cooperate in fulfilling the obligation of customs information disclosure. acbuy does not make any promises or guarantees for customs clearance.

IV. Agreement update and user’s maintenance obligations

1. As acbuy’s business develops, this service agreement may be updated from time to time to provide you with better services. However, without your explicit consent, acbuy shall not reduce your rights under this agreement. acbuy will publish the updated version on the acbuy website and mobile terminal and notify you through website announcements or other appropriate means before the updated relevant content takes effect. Please visit acbuy to learn about the latest service agreement.

2. acbuy will give significant notice of any major changes to it (for this purpose, acbuy will explain the specific changes to our privacy policy by means including but not limited to email, SMS or special prompts on the browsing page).

3. You are obligated to pay attention to and read the latest version of the agreement and acbuy announcements from time to time. If you do not agree to the updated agreement, you should immediately stop accepting the services provided by acbuy according to this agreement; if you continue to use the services provided by acbuy, it will be deemed that you have agreed to the updated agreement. If any term of this agreement is abolished, invalid or unenforceable for any reason, such term shall be deemed severable and shall not affect the validity and enforceability of any remaining terms.

4. The conclusion, execution, interpretation and dispute resolution of this agreement shall be governed by the laws of United Kingdom. If there is any dispute between the two parties regarding the content of this agreement or its execution, the two parties shall try their best to resolve it through friendly negotiation; if negotiation fails, a lawsuit shall be filed with the people’s court with jurisdiction at.

Legal statement and privacy policy

acbuy attaches great importance to the protection of users’ privacy and personal information. When you use our products or services, we may also collect and use information about you. We are willing to explain through this privacy policy how we collect, use, store, share and transmit this information when you use our products or services, and the ways we provide you to access, update, delete and protect this information, including but not limited to synchronously transmitting your platform account ID and acbuy website operation behavior to shopping platform partners such as Taobao and 1688. The specific terms of the privacy policy are subject to acbuy’s “acbuy User Privacy Policy”.
